Survey Assistant: Terms of Service
Please review these Terms of Service ("Terms") and our Privacy Notice carefully, as they regulate your use of the SurveyAssistant.ai website, survey creation services, and any content produced by our services based on your User Content ("Generated Content"). For simplicity, the website, services, and Generated Content are collectively referred to as the "Services."
Acceptance of Terms
By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Privacy Notice
Please review our Privacy Notice, which also governs your use of our Services, for information on how we collect, use and share your information.
Who May Use the Services
To use the Services, you must be at least 18 years of age. By accessing or using the Services, you represent and warrant that you meet these eligibility requirements.
Some features of the Services require an account. Providing and maintaining precise, comprehensive, and current account information is essential. Failing to do so might result in account suspension or termination. To secure your account, maintain the confidentiality of your account details and password, and promptly inform us of unauthorised usage. You are liable for all activities under your account.
SurveyAssistant.ai may mandate payment for using the Services (or specific portions) and you consent to pay such fees.
(a) General. Upon purchasing a Subscription, you authorise us (or our third-party payment processor) to charge you. We may request additional information related to your Subscription, including your credit card details, expiration date, and billing contact information ("Payment Information"). You warrant that you possess the legal right to use all represented payment methods. Initiating a Subscription authorises us to share your Payment Information with third parties to complete the transaction and charge your payment method accordingly (including applicable taxes and charges). Additional information may be required to verify your identity (included within Payment Information). By starting a Subscription, you consent to the relevant pricing, payment, and billing policies. Subscription payments are non-refundable and non-transferable, except as specified in these Terms. All fees and taxes are payable in US dollars.
(b) Subscriptions. Purchasing a Subscription incurs an annual fee, taxes, and charges ("Subscription Fee") at the start of the Subscription and yearly thereafter, based on the current fee. Surveyassistant.ai is authoristed to initiate recurring non-refundable payments. Upon purchasing a Subscription, we (or our third-party payment processor) will charge you annually using the provided Payment Information until you cancel. SurveyAssistant.ai will send a reminder of the current Subscription Fee 30 to 60 days before your Subscription term expires or in compliance with the law. By purchasing a Subscription, you acknowledge its recurring nature and accept responsibility for payment obligations until cancellation. Subscriptions continue until you cancel or we terminate access in accordance with these Terms.
(c) Cancelling Your Subscription. You can cancel within ten (10) days of the initial purchase for a full refund. Subsequently, cancellations and refunds are unavailable. However, we reserve the right to cancel transactions for any reason and provide a refund. Cancellation takes effect at the end of the current Subscription period, and no refunds will be provided for that period. To cancel, email cancel@surveyassistant.ai.
Your Content.
(a) User Content. The Services may enable you to store or share various types of survey content. Everything you post or share, except Feedback, is considered "User Content." SurveyAssistant.ai doesn't claim ownership rights in User Content.
(b) Permissions for User Content. By sharing User Content, you grant SurveyAssistant.ai, its licensors, and affiliates a non-exclusive, transferable, perpetual, irrevocable, global, royalty-free, fully paid-up licence to use, store, modify, create derivative works, distribute, display, and perform your User Content in connection with their services.
(c) Responsibility for User Content. You are solely accountable for your User Content. You warrant that you have the necessary rights to grant us the licence under these Terms and that your User Content doesn't violate any third-party rights or applicable laws.
(d) Removing User Content. You can delete your User Content, but some content may not be entirely removed. We are not liable for the removal or failure to remove your User Content.
(e) Use of Generated Content. SurveyAssistant.ai grants you a non-exclusive, global licence to use, modify, sell, create derivative works, distribute, display, and perform Generated Content for lawful business purposes, subject to compliance with these Terms.
(f) Intellectual Property Ownership. The Services may include content subject to intellectual property rights, such as Generated Content. We and our licensors retain all rights to that content.
Usage Requirements, Prohibitions, and Enforcement Rights.

SurveyAssistant.ai may monitor Services and remove content for operational or legal purposes. We may investigate violations and cooperate with law enforcement.
Links to Third Party Websites or Resources.
The Services may allow you to access third-party websites or other resources, such as Google Forms, Typeform. We provide access only as a convenience and are not responsible for the content, products or services on or available from those resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party resources.
Limitation of Liability.
(a) To the fullest extent allowed by law, neither SurveyAssistant.ai nor its providers and licensors will be liable for any indirect, special, or consequential damages, lost profits, revenues, savings, business opportunities, data, goodwill, service interruption, computer damage, system failure, or the cost of substitute services from the use or inability to use the Services, regardless of the legal theory and even if informed of such damage. This applies even if a limited remedy has failed its essential purpose.
(b) Under applicable law, SurveyAssistant.ai's total liability will not exceed the amounts paid or payable by you for the Services, or $100 if no payment obligations exist.
General Terms
(a) Entire Agreement. These Terms form the exclusive understanding between SurveyAssistant.ai and you, superseding prior agreements. Invalid or unenforceable provisions will be enforced to the maximum extent permissible, while others remain in effect. You cannot assign or transfer these Terms without prior written consent. SurveyAssistant.ai can freely assign or transfer them without restriction.
(b) Notices. SurveyAssistant.ai will provide notices under these Terms via email or by posting on the Services.
(c) Waiver of Rights. SurveyAssistant.ai's failure to enforce any provision doesn't waive that right. A waiver must be in writing and signed by an authorised representative. Remedies under these Terms don't affect other remedies available.
